GOOD CAUSE EVICTIONS

Good Cause Eviction is now the law in New York City, and we are ready to handle new cases. Watch for our posts as these new regulations get interpreted and litigated. For now, here are the basics:

MAIN EXEMPTIONS FROM GOOD CAUSE EVICTIONS:

  • Premises owned by a small landlord (owns no more than 10 units in the state);
  • Owner-occupied housing unit with no more than 10 units;
  • Unit occupied incident to employment only;
  • Otherwise regulated units such as Rent Stabilization or Rent Control;
  • Co-ops and condominiums;
  • High-rent units as defined by the statute.

GOOD CAUSE FOR EVICTION UNDER THE STATUTE:

  • Failure to pay rent;
  • The tenant has violated a substantial obligation of their tenancy or breached any of the landlord’s rules and regulations;
  • The tenant is committing a nuisance;
  • Occupancy of the unit is or causes a violation of law;
  • Unit is being used for illegal purposes;
  • Owner occupancy is desired.
